Owners Corporations in Victoria – Update

Owners corporations and insurers in Victoria and whoever was waiting for the changes to section 18 of the Owners Corporation Act 2006 (Vic), section 18 of the Act is now changed!

There is no longer a requirement for a special resolution to be passed for owners corporations to be able to commence legal proceedings in the Magistrates Court. The new section 18 authorises owners corporations to commence legal proceedings in the Magistrates Court, VCAT and a court of another state or territory that corresponds to the Magistrates Court by way of an “ordinary resolution”.

The new threshold of section 18 came into force on 01 December 2021.
